Terms of use

These terms apply when you use hotchickz.com, order online, join Hot Chickz Rewards or get texts from Hot Chickz ("we", "us"). By using the site or placing an order you agree to them and to our Privacy policy. If you don't agree, please don't use the site.

Using this site

Menu items, prices, hours and availability can change without notice and can differ between our Pontiac and Coliseum stores. Photos show how we serve our food; your order may look a little different. Please don't misuse the site, try to break its security, use bots to place orders or collect data, or use someone else's phone number or account.

Online orders

• Online orders are for pickup at the store shown at checkout. Please check the store before you pay.
• A phone number and your first and last name are required so we can reach you about your order.
• Your order is placed only after your payment is approved and you see the confirmation screen. If your payment is declined, the order is not made.
• ASAP orders are usually ready in about 15 to 20 minutes. Scheduled orders are started shortly before the pickup time you choose. Times are estimates and busy times can cause delays.
• If an item becomes unavailable after you order, we'll contact you to swap it or refund it.
• Orders not picked up within 2 hours of the pickup time may be thrown away for food safety, and may not be refunded.
• We may refuse or cancel an order if we suspect fraud, if prices were shown wrong because of an error, or if the store can't fill it. If we cancel, we refund what you paid.

Payments

Prices are in US dollars. Indiana sales tax and the local food and beverage tax are added at checkout. Payments are processed by Clover, including Apple Pay and Google Pay. By paying you confirm you're allowed to use that payment method. A declined payment may show as a temporary hold by your bank, which your bank releases; you are only charged for orders that go through.

Changes, cancellations and refunds

To change or cancel, call the store you ordered from right away. Once your food is being made we may not be able to cancel it. If something is missing or wrong, tell the store the same day and we'll make it right with a replacement, credit or refund. Refunds go back to the original payment method and may take a few business days to appear. Points earned on a refunded order may be removed, and points used on a refunded order are given back.

Allergies and spice

Our food is made in kitchens that handle wheat, milk, eggs, soy and other allergens, and cross-contact can happen. We can't guarantee any item is allergen-free. Tell us about any allergy before you order. Our higher spice levels are extremely hot; please choose with care, especially for children.

Hot Chickz Rewards program

• Who can join: anyone 13 or older with a US mobile number. One account per phone number. Joining is free. We text a code to confirm the phone is yours, and you choose a 4-digit PIN.
• Earning: 1 point for each $1 spent before tax and tips, rounded to the nearest point (50 cents or more counts as 1). Points are earned online and at both stores when you give your phone number at the register. Points for in-store orders usually appear within minutes.
• Welcome bonus: new members who join online get bonus points (currently 25) added with their first paid order.
• Using points: 200 points = $10 off (or the amount shown at the time). Online, you use points at checkout with your PIN; in the store, with your PIN at the register. If your order is less than the reward, the reward covers it and only the points needed are used. You can use points up to 5 times a day. Points are taken only when the order is placed.
• Levels: your level (Mild, Hot, Blaze, Reaper, Hot Chickz Legend) is based on points earned over time and does not go down.
• Birthday: if you add your birthday to your profile, you may get a birthday gift when we offer one, once a year. Your birthday can be set once; to fix it, contact a store.
• Expiration: points expire if your account has no activity for 12 months.
• No cash value: points and rewards have no cash value, can't be sold, transferred or combined between accounts, and can't be exchanged for cash, except where the law requires.
• Returns and declines: no points are earned on declined, canceled or refunded orders. If points were already given, we remove them.
• Your PIN: keep it private. Anyone with your phone number and PIN can use your points. If you forget it, you can reset it with a texted code.
• Misuse: we may remove points or close accounts used for fraud, abuse, or against these terms.
• Changes: we may change how points are earned or used, or end the program. We'll post changes on this page, and if we end the program we'll give at least 30 days' notice so you can use your points.

Text message terms

• Program: Hot Chickz Rewards and order texts from Hot Chickz.
• What you'll get: codes to confirm your phone, alerts when a reward is ready or you reach a new level, birthday messages and occasional offers. Message frequency varies.
• Consent: you agree to these texts when you join Rewards or ask for a code. Agreeing is not required to buy anything. You can turn offer texts off in your Rewards profile.
• Stop or help: reply STOP to stop texts at any time, and HELP for help, or call either store.
• Costs: message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Promotions and events

Promotions, giveaways, events and coupons have their own rules, can't be combined unless stated, are limited to what's available and may end at any time. No purchase is necessary for giveaways unless the rules say otherwise.

Your account

You're responsible for activity on your Rewards account and for keeping your PIN private. Tell us right away if you think someone else used it.

Legal terms

• Content: the Hot Chickz name, logo, photos, videos and website belong to Hot Chickz. Please don't copy or reuse them without permission.
• No warranties: the site is provided "as is". We work to keep it accurate and running, but we can't promise it will always be available or error-free.
• Limit of liability: to the fullest extent Indiana law allows, our total liability for any claim about the site, an order or Rewards is limited to the amount you paid for the order involved. Nothing here limits rights you have under law that can't be waived.
• Governing law: these terms are governed by the laws of the State of Indiana. Any dispute will be handled in the state or federal courts located in Allen County, Indiana, and you and we agree to those courts.
• Changes: we may update these terms. The date at the top shows the latest version. Using the site after a change means you accept the new terms.
• If any part of these terms can't be enforced, the rest still applies.
